The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Application means the software program provided by the Company and downloaded by You on any Device, named Quick Mind.
Application Store means the digital distribution service operated by Apple Inc. (Apple App Store) or Google LLC (Google Play Store) through which the Application has been made available for download.
Account means a unique account — which may be anonymous or linked to a Third-Party Identity Provider — created for You to access Our Service or parts of Our Service.
Affiliate means an entity that controls, is controlled by, or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest, or other securities entitled to vote for election of directors or other managing authority.
AI-Generated Content means any lessons, summaries, explanations, quiz questions, flashcards, recommendations, personalizations, or other outputs produced or adapted by artificial intelligence systems operated by or on behalf of the Company within the Service.
Company (referred to as either "the Company", "We", "Us", or "Our" in this Agreement) refers to Impossible Apps, Rua Paulo Cézar Fidélis, 39, Campinas, SP, Brazil.
Content means any text, images, audio, data, or other material that is displayed, generated, transmitted, or otherwise made available through the Service, including AI-Generated Content and any content submitted by You.
Device means any device capable of accessing the Service, such as a smartphone, tablet, or computer.
Service refers to the Application and all related features, content, and functionality provided by the Company.
Subscription (also referred to as a "Premium Plan") means a recurring paid plan that grants You access to additional features, content, or usage allowances within the Service, as further described within the Application.
Terms and Conditions (also referred to as "Terms") means these Terms and Conditions, which form the entire agreement between You and the Company regarding the use of the Service.
Third-Party Identity Provider means an external authentication service — such as Sign in with Apple or Sign in with Google — that You may use to create or access Your Account.
You means the individual accessing or using the Service, or the legal entity on behalf of which such individual is accessing or using the Service, as applicable.
These Terms and Conditions govern Your use of the Service and constitute the agreement between You and the Company. They set out the rights and obligations of all users with respect to the Service.
Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms apply to all users who access or use the Service in any capacity.
By accessing or using the Service, You agree to be bound by these Terms and Conditions. If You do not agree with any part of these Terms, You may not access the Service.
The Service is intended for users who are of the age of majority in their jurisdiction. If You are a minor, You may only use the Service with the consent of a parent or legal guardian, to the extent permitted by applicable law. By using the Service, You represent that You meet these eligibility requirements.
Your access to and use of the Service is also conditioned on Your acceptance of the Company's Privacy Policy, which describes how We collect, use, and disclose Your personal information. Please read Our Privacy Policy carefully before using the Service.
The Service may offer Subscriptions and other paid plans that unlock additional features, content, or usage allowances. Details of available plans are described within the Application.
All purchases, including Subscriptions, are processed by the Application Store from which You downloaded the Application and are subject to that Application Store's own terms and conditions. The Company does not directly process payments.
Subscriptions may renew automatically at the end of each billing period unless cancelled. You are responsible for managing Your Subscription, including cancellation, through Your Application Store account settings. The Company has no ability to issue refunds directly; all refund requests must be directed to the relevant Application Store in accordance with its refund policy.
The Company reserves the right to change Subscription pricing, plan contents, or available tiers at any time. Where required by applicable law, We will provide reasonable advance notice of material pricing changes. Your continued use of the Service following such changes constitutes Your acceptance of the new terms.
If You have any payment-related issues, please contact the Application Store directly.
You may access certain features of the Service through an anonymous Account or by linking Your Account to a Third-Party Identity Provider such as Sign in with Apple or Sign in with Google. If You provide registration information, You agree that such information is accurate, complete, and current at all times. Providing inaccurate information constitutes a breach of these Terms and may result in suspension or termination of Your Account.
You are responsible for maintaining the security of Your Device and Account credentials. You are solely responsible for all activity that occurs under Your Account, whether or not You authorized it. If You become aware of any unauthorized use of Your Account, You should notify Us promptly.
You may not sell, transfer, share, or otherwise allow any other person to access Your Account or Account credentials, or offer to do so.
We may disable or terminate Your Account if it remains inactive for an extended period of time, or if We reasonably believe Your Account has been compromised or is being used in violation of these Terms.
The Service uses artificial intelligence systems to generate, adapt, summarize, rank, and personalize Content for You. The nature, format, and accuracy of AI-Generated Content may vary across users and sessions.
No guarantee of accuracy. AI-Generated Content may be inaccurate, incomplete, outdated, misleading, or otherwise unsuitable for particular purposes. You are solely responsible for evaluating any AI-Generated Content before relying on it.
Not professional advice. The Service is designed for general educational and informational use only. AI-Generated Content does not constitute, and must not be treated as, medical, legal, financial, tax, investment, psychological, therapeutic, or any other form of professional advice. You should always seek the guidance of a qualified professional for matters of that nature.
Content moderation. The Company may, at its sole discretion, filter, block, modify, delay, or refuse to generate prompts, outputs, or features for reasons including safety, applicable law, third-party rights, or abuse prevention. The Company reserves the right to adjust the AI systems, models, and features used to generate Content at any time without notice.
Reporting tools. If the Service provides tools for You to report or flag AI-Generated Content that You believe is inaccurate, harmful, or inappropriate, You agree to use those tools honestly and in good faith. Misuse of reporting tools is a violation of these Terms.
The Service may allow You to submit prompts, inputs, feedback, or other content ("User Content") to interact with the AI systems or to improve the Service. You retain any rights You hold in Your User Content.
By submitting User Content, You represent and warrant that You have all rights and permissions necessary to submit that content and that doing so does not violate applicable law or the rights of any third party.
You grant the Company a non-exclusive, worldwide, royalty-free licence to use, process, reproduce, and analyse Your User Content to the extent necessary to operate, secure, personalise, support, and improve the Service, in accordance with Our Privacy Policy and applicable law.
You are solely responsible for any User Content You submit. The Company is not responsible for User Content submitted by You or any other user.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
Use the Service for any unlawful, harmful, abusive, defamatory, fraudulent, or infringing purpose, or in violation of any applicable local, national, or international law or regulation;
Attempt to generate or extract content that is prohibited by these Terms, Our content policies, or applicable law, including content that is obscene, harassing, or that infringes third-party rights;
Scrape, harvest, crawl, or extract data, Content, or AI-Generated Content from the Service in bulk or by automated means, whether for commercial or non-commercial purposes;
Attempt to reverse engineer, decompile, disassemble, or otherwise extract the source code, underlying models, prompts, algorithms, or proprietary logic of the Service or any component thereof;
Use bots, scripts, macros, automated tools, or other means to access, interact with, or use the Service in a manner that creates abnormal or disproportionate load, circumvents usage limits, or impersonates normal human use;
Bypass, disable, or interfere with any technical protection measures, access controls, paywalls, rate limits, or other security features of the Service;
Knowingly exploit bugs, vulnerabilities, or errors in the Service for any purpose, including to obtain access to Content or features not intended for You;
Introduce any virus, malware, spyware, or other harmful code into the Service or its infrastructure;
Impersonate any person or entity, or misrepresent Your identity or affiliation with any person or entity;
Use the Service in any manner that could damage, disable, overburden, or impair the Service or interfere with any other user's ability to use the Service.
Violation of this section may result in immediate suspension or termination of Your Account and, where applicable, referral to relevant law enforcement authorities.
The Service depends on or integrates with third-party services, including but not limited to Application Stores, payment processors, authentication providers (such as Apple and Google), analytics platforms, and AI infrastructure providers. These third-party services are governed by their own terms of use and privacy policies, which You may be required to agree to separately.
The Company does not control, and is not responsible for, the availability, accuracy, content, or practices of any third-party service. The Company shall not be liable for any damage or loss caused or alleged to be caused by Your use of, or reliance on, any third-party service.
We strongly advise You to read the terms and conditions and privacy policies of any third-party services You use in connection with the Service.
The Service may contain links to third-party websites or services that are not owned or controlled by the Company.
The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.
We strongly advise You to read the terms and conditions and privacy policies of any third-party websites You visit.
The Company reserves the right to modify, update, suspend, or discontinue any aspect of the Service at any time, including features, lesson formats, AI models, content topics, usage quotas, or plan benefits, with or without notice.
The Company does not guarantee that any specific AI model, feature, content category, or plan benefit will remain available indefinitely. We will make reasonable efforts to communicate material changes that affect paid Subscriptions, but the Service is provided on an evolving basis and We cannot guarantee continuity of any specific functionality.
We may suspend or terminate Your Account or Your access to the Service immediately, without prior notice or liability, for any reason, including if You breach these Terms and Conditions, engage in abusive or fraudulent conduct, or if We are required to do so for legal or compliance reasons.
Upon termination, Your right to use the Service will cease immediately. You may discontinue using the Service at any time. Termination of Your Account does not entitle You to any refund of amounts paid, except as required by applicable law or the relevant Application Store's refund policy.
Provisions of these Terms that by their nature should survive termination — including limitations of liability, disclaimers, and governing law — shall survive termination.
To the maximum extent permitted by applicable law, the total liability of the Company and its Affiliates, licensors, and service providers arising out of or in connection with these Terms or Your use of the Service shall not exceed the amount actually paid by You through the Service in the twelve (12) months preceding the event giving rise to the claim, or one hundred United States Dollars (USD 100), whichever is greater.
To the maximum extent permitted by applicable law, in no event shall the Company or its Affiliates, licensors, or service providers be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, business interruption, or personal injury, arising out of or in connection with Your use of or inability to use the Service.
Without limiting the foregoing, the Company shall not be liable for any decisions, actions, losses, or harm arising from Your reliance on AI-Generated Content. You acknowledge that AI-Generated Content is provided for general informational and educational purposes only and that any reliance You place on such content is at Your sole risk.
Some jurisdictions do not allow the exclusion or limitation of certain types of liability, so some of the above limitations may not apply to You. In such jurisdictions, the Company's liability shall be limited to the greatest extent permitted by law.
The Service, including all AI-Generated Content, is provided to You on an "AS IS" and "AS AVAILABLE" basis, with all faults and defects, and without warranty of any kind. To the maximum extent permitted by applicable law, the Company, on its own behalf and on behalf of its Affiliates and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
Without limiting the foregoing, the Company makes no warranty or representation that:
the Service will meet Your requirements or achieve any particular result;
AI-Generated Content will be accurate, complete, current, reliable, or suitable for any specific purpose;
the Service will be available without interruption, or free of errors, bugs, or harmful components;
any errors or defects in the Service will be corrected;
the Service will be compatible with Your Device, operating system, or any other software or service; or
the Service will produce the educational outcomes or personal development results You desire.
Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer. In such jurisdictions, the exclusions and limitations set out in this section shall apply to the greatest extent enforceable under applicable law.
The laws of the Country, excluding its conflicts of law rules, shall govern these Terms and Your use of the Service. Your use of the Service may also be subject to other local, state, national, or international laws.
If You have any concern or dispute about the Service, You agree to first attempt to resolve the matter informally by contacting the Company using the details provided at the end of these Terms.
If You are a European Union consumer, You will benefit from any mandatory provisions of the law of the country in which You are resident.
You represent and warrant that (i) You are not located in a country that is subject to a United States government embargo or that has been designated by the United States government as a "terrorist supporting" country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.
If any provision of these Terms is held to be unenforceable or invalid, that provision will be modified and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter, nor shall a waiver of any breach constitute a waiver of any subsequent breach.
These Terms and Conditions may be made available in languages other than English. You agree that the original English text shall prevail in the event of any dispute or inconsistency arising from a translation.
We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material, We will make reasonable efforts to provide at least 30 days' notice before the new terms take effect. What constitutes a material change will be determined at Our sole discretion.
By continuing to access or use the Service after any revised Terms become effective, You agree to be bound by the revised Terms. If You do not agree to the new Terms, in whole or in part, You should stop using the Service.
